By accessing and using the Path Out Of Pain website (www.pathoutofpain.com) and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

Path Out Of Pain provides educational information and coaching services related to chronic pain management through mindbody approaches. Our services include:

• One-on-one coaching sessions
• Educational resources and materials
• Digital content and guides
• Pain Reprocessing Therapy (PRT) techniques
• Elements of Emotional Awareness Expression (EAET) and Internal Family Systems (IFS) therapy

3. Medical Disclaimer

IMPORTANT: Our services are not medical treatment and do not replace professional medical care.

• Ed Giles is a Holistic Life Coach and Mindbody Practitioner, not a licensed medical professional
• The information and services provided are for educational and coaching purposes only
• You should not discontinue or change any medical treatment without consulting your healthcare provider
• If you have a medical emergency, contact emergency services immediately
• We recommend consulting with your healthcare provider before beginning any new pain management approach

4. No Guarantees of Results

While we are committed to providing quality coaching services:

• Individual results may vary significantly
• We cannot guarantee specific outcomes or recovery timelines
• Your progress depends on many factors including your commitment, consistency, and individual circumstances
• Past client testimonials do not guarantee future results

5. Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information about your condition and health history
• Maintain regular communication about your progress and any concerns
• Follow safety guidelines and recommendations provided during sessions
• Inform us of any changes in your medical condition or treatments
• Take responsibility for your own health and well-being decisions

6. Payment Terms, Cancellation and Refund Policy

Payment Terms:

• Payment is due before the delivery of the first session
• Accepted payment methods: cash, online bank transfer, or PayPal
• Late payment will incur a £10 administration fee

Session Cancellations:

• Cancellations must be made at least 24 hours in advance (business days)
• Late cancellations or no-shows may result in full session charges
• Emergency cancellations will be considered on a case-by-case basis

Refunds:

• Refunds for services may be requested within the first 30 days of purchase
• Refund requests must be submitted in writing to admin@pathoutofpain.com
• A £50 administration fee will be deducted from all approved refunds
• No refunds will be given for sessions that have already been delivered
• Digital products and completed sessions are non-refundable
• Refunds are processed within 14 business days of approval

7. Privacy, Confidentiality and Data Protection

Session Recording and Data Collection:

• Sessions may be recorded for note-taking and professional development purposes
• Your explicit consent will be obtained before any recording takes place
• You have the right to decline recording without affecting your treatment
• All recordings and session notes are kept strictly confidential

Data Protection and Storage:

• We comply with UK GDPR and data protection regulations
• All client notes and recordings are stored on offline, password-protected devices
• Personal data is retained for 7 years in accordance with professional standards
• You have the right to request access to, correction of, or deletion of your personal data

Path Out Of Pain maintains comprehensive professional insurance coverage through Balens Limited:

• Professional liability insurance: £4,000,000 per claim
• Public liability insurance: £4,000,000 per claim
• Commercial legal protection coverage
• This coverage protects both our practice and clients within the scope of our coaching services
• Insurance details are available upon request

Limitation of Liability:
To the fullest extent permitted by law:

• Path Out Of Pain and Ed Giles shall not be liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount paid for our services
• We are not responsible for any decisions you make based on our coaching or information provided
• You assume all risks associated with implementing our recommendations
• Our insurance coverage operates within the defined scope of coaching services as outlined in Section 2

10. Age Requirements and Parental Consent

Minimum Age:

• Our services are provided to clients aged 18 years and above
• Clients under 18 may access services only with explicit written consent from a parent or legal guardian
• The parent or guardian must be present during initial consultation for minors
• All terms and conditions apply equally to services provided to minors with parental consent

When using our services, you agree to:

• Treat all staff and other clients with respect
• Not engage in any illegal or harmful activities
• Respect the confidentiality of other clients
• Use our services only for their intended purposes
• Not share login credentials or access to paid content

Online Session Requirements:

• You must have a device with a working camera and microphone
• A stable internet connection capable of handling video calls is required
• We recommend using updated browsers (Chrome, Firefox, Safari, Edge)
• Technical issues during sessions may require rescheduling

Website Access:

• We strive to maintain website availability but cannot guarantee uninterrupted access
• We may modify or discontinue website features at any time
• You are responsible for maintaining the security of your account information

Communication:

• We may communicate with you via email, phone, or video calls
• We recommend using secure internet connections for privacy during sessions

Business Hours:

• Our standard business hours are 9:00 AM to 5:00 PM, Monday through Friday
• Outside these hours, responses may be delayed until the next business day

Emergency Procedures:

Crisis Support:

Either party may terminate the coaching relationship:

• Clients may discontinue services at any time
• We reserve the right to terminate services if terms are violated
• Upon termination, access to materials and ongoing support will cease
• Any unused session credits will be handled according to our refund policy

Professional Membership:

• Ed Giles is a registered member of The Complementary Medical Association (CMA)
• Our practice adheres to CMA’s ethical standards and professional guidelines
• CMA membership demonstrates our commitment to professional excellence in complementary medicine

Compliance with Laws: Our services are provided in compliance with applicable laws and professional standards:

• We operate within the scope of coaching and educational services as defined by CMA guidelines
• We do not provide medical diagnosis or treatment
• We comply with data protection regulations including UK GDPR
• Services are provided primarily to clients in Scotland and the UK
